For the business relationship between ElMod GbR and the customers, exclusively the following general business terms and conditions are valid in the version valid at the point in time of the order. This is also valid for future business transactions. We do not recognize deviating business terms and conditions of the customer unless we explicitly agreed upon their validity in writing. These business terms and conditions are not valid for customers living in Germany, Austria or Suisse.

The order of the customer is a binding offer. The purchase contract is completed if we have confirmed the order within this time period in writing or the delivery has been carried out. If unexpectedly the ordered items should no longer be in supply or cannot be delivered, we are not obliged to carry out the order. The offer of the customer relates to goods as they are shown and described on our website. Small deviations of the goods as compared to the portrayal on our website in colour or design are reserved. We are entitled to deliver equal goods pertaining to the quality and price in place of the ordered goods. We are entitled to cancellation with typing, printing or calculating errors on the website.

Packaging and shipping costs will be billed to the customer separately.
Within Germany: 7,50 EUR
EU including Suisse: 7,90 EUR
Outside EU: 12,50 EUR, subject to change.
In any case, customers will receive a detailed bill via e-mail including all costs.

Orders will be processed as promptly as possible (usually within 2 workdays) after receiving customers credit note.
Stoppages, strikes or other constraints outside the control of Elmod GbR releases ElMod GbR from the obligation to execute an order. ElMod GbR cannot be held liable for ensuing damages. Claims for damages are excluded except for damage caused intentionally or through gross negligence.
We reserve the type of shipping insofar as a specific mode of shipping has not been agreed upon in writing with the purchaser.
Information on the terms of delivery are always unbinding insofar as a specific delivery date has not been agreed upon as an exception and explicitly.

All invoices are in Euro and must be paid for in this currency. All payment methods are shown while customers checkout processes. All prices incude the VAT (sales tax within Germany). Unfortunately we are unable to deduct VAT from orders placed by customers living outside of the European Union.

ElMod GbR always aims to guarantee all customers satisfaction. ElMod GbR is obliged and willing to allow customers to cancel an order at any time up to the end of the 28ht. working day, starting from the day after receipt of the goods. When returning goods from abroad it is necessary to contact us first.
The right of returning a purchase is not valid for goods, which were made by individual order of a customer.

All orders are sent at the recipient’s cost and risk. Lost or orders cannot be replaced. Recipients themselves must assert any claims against the post office, railway, carriers or other delivery services.

If there is a defect of the object of purchase which is our fault, Elmod GbR is entitled according to their own choice to repair the defects or substitute the delivery. If Elmod GbR is not willing to repair the defects or substitute the delivery or is unable to or this exceeds an adequate deadline for reasons which are Elmod GbR fault or if in another way the repair of the defect or substitution of the delivery fails, the customer is entitled according to his own choice to withdraw from the contract or to demand a corresponding lowering of the purchase price.
Insofar as legally admissible, further claims on part of the customer, no matter for which legal ground, are excluded. This is also valid for the personal liability of employers, representatives and assistants.
Insofar as we have breached a duty which is essential to the contract, the liability to pay damages for damage to property or personal injury is limited to the damage which typically results.
The legal guarantee deadlines are valid, starting with the passing of the risk. This deadline is a period of limitation and is also valid for claims for replacement of damages caused by a defect insofar as no claims are in tort.
Elmod GbR assumes no liability for defects which have resulted from improper handling or which are based on normal wear and tear.
Reprimands for defects are to be passed on to ElMod GbR in writing immediately after the acknowledgement of the customer.

Goods remain property of ElMod GbR until the complete settlement of all claims which exist against the customer arising from this business connection. In case of installation our goods as a part of a whole, ElMod GbR establishs a partial claim of the whole in size of the order value.

All datas were strictly kept confidential. They were only transmitted to third parties if it is necessary to handle your order.
This might be e.g. at shipping, so your adress is known to the postal service.
 
The storage of your datas is reglemented in Germany by the so called "Bundesdatenschutzgesetzes" (federal law about using datas).
 
At any case no datas will be transfered to third parties to use them for market analysis, research of your shopping behaviour or other marketing activities.

Should any individual provision of these terms of delivery and payment be or become void, the validity of the remaining provisions hereof and any contracts concluded on the basis of these terms of delivery and payment shall in no way be affected. In such a case, the void provision shall be replaced by a relative provision coming as close as possible to the commercial purpose of the void provision. Failure by ElMod GbR to exercise rights - even over a long period - does not give the customer the right to plead that ElMod GbR has waived these rights.
Place of jurisdiction and performance for demands by ElMod GbR on all deliveries is Nürtingen (Germany). ElMod GbR also has the right to assert claims at the place of business of the customer.
